On January 9, 2026, Aquestive announced that the FDA had identified deficiencies in its New Drug Application for Anaphylm that precluded discussions of labeling and post-marketing commitments. Following this news, Aquestive's stock price declined 37%. According to a securities class action complaint, between June 2025 and January 2026, Aquestive misled investors about the prospects for FDA approval of Anaphylm, including by representing that approval remained on track for the January 31, 2026 target action date.
