SAN FRANCISCO, Oct. 23, 2026 /PRNewswire/ -- The San Francisco City Attorney's Office announces settlement has been reached in a lawsuit brought by the People of the State of California, through the San Francisco City Attorney, against InComm Financial Services, the company that sells Vanilla Gift Cards. The lawsuit alleged that Vanilla Gift Cards were susceptible to package tampering, allowing criminals to access card information before purchase and make unauthorized transactions. InComm denies the allegations.
The total Restitution Fund is $1,525,000. To be considered for payment, you must submit a Claim Form and Attestation by February 19, 2027. For complete information, visit www.CAGiftCardSettlement.com, call 1-888-808-2479, or email info@CAgiftcardsettlement.com.
Who is eligible? You may be eligible if you are a California resident who (1) purchased a Vanilla Gift Card in California between November 1, 2019 and September 30, 2024, or received or otherwise lawfully acquired a Vanilla Gift Card purchased in California during that period; (2) was unable to use some or all of the card's balance because of one or more unauthorized transactions; (3) believes the unauthorized transactions resulted from package tampering; and (4) has not received a refund from InComm for the funds you lost.
What does the Settlement provide? The Restitution Fund will provide payments to eligible Claimants. A Claimant who submits a complete Proof of Claim may be eligible for payment for the full value of reported lost funds for each eligible Vanilla Gift Card. A Claimant who submits an incomplete Proof of Claim may be eligible for up to 75% of reported lost funds, depending on the documentation provided. Without a Proof of Claim, a Claimant may be eligible for up to $15 per Vanilla Gift Card, for no more than two cards and a maximum total payment of $30.
Proof of Claim is optional but may increase the payment for which you are eligible. Payment amounts may be adjusted based on the number and value of valid claims and the amount available in the Restitution Fund.
How do I submit a claim? To seek payment, submit a complete Claim Form and Attestation online at www.CAGiftCardSettlement.com or mail the claim materials and any supporting documentation to:
