Alibaba Scores U.S. Legal Win in Pentagon Lobbying Ban Challenge
By Tracy Qu
Alibaba Group has won a preliminary injunction from a U.S. court as part of a legal challenge to its inclusion on a Department of Defense list of companies with alleged ties to China's military.
A federal judge in the Northern District of California on Monday blocked the enforcement of a ban barring the Pentagon from doing business with any company that engages in "lobbying activities" for Alibaba.
The ruling comes after the Defense Department in June added Alibaba to a list of entities seen as posing potential national security risks due to alleged links to China's military. The designation restricts how those firms operate in the U.S. and effectively shuts companies whose lobbyists represent Alibaba out of Pentagon contracts.
Alibaba's removal from the list will be decided separately, according to the court order.
The Chinese e-commerce and technology giant has previously denied any connection to the Chinese military or military-civil fusion strategies.
Alibaba didn't immediately respond to a request sent Tuesday seeking comment on the court ruling. The Defense Department didn't immediately reply to a request sent outside of normal business hours.
Chelsey Tam, an analyst at Morningstar, sees little financial impact from the latest developments. Neither the lobbying ban nor the court order have much effect on Alibaba's business as the company has a negligible footprint in the U.S., she said.
That said, the broader overhang for Alibaba's stock remains intact--in the form of potential deterrence of U.S. institutional investors and corporate partners-- until the blacklist designation itself is resolved, Tam added.
"We view the preliminary injunction as a symbolic and procedural win for Alibaba rather than a fundamental game-changer," she said.
