Swisscom Wins Appeal Against Swiss Antitrust Fine Over Fiber Network Expansion

By Adria Calatayud

Swisscom won an appeal at Switzerland's Federal Administrative Court against a decision by the country's antitrust regulator to fine the company over its fiber-network expansion plans.

The court said late Tuesday that there was no breach of competition law by Swisscom's network expansion as the company doesn't have a dominant position on the relevant market, and overturned a ruling by the Swiss Competition Commission that imposed obligations on the company as well as a 18 million Swiss-franc ($21.6 million) fine.

Telecommunications operator Swisscom said in response that it remains committed to advance its fiber rollout at pace, and that it would analyze the potential implications of the judgment for the further expansion of its infrastructure. The group's 2026 outlook is unchanged, it added.

Comco didn't immediately respond to a request for comment.

The case stemmed from Swisscom's plans to expand its fiber-optic network set out at the beginning of 2020, which prompted Comco to open a probe and issue precautionary measures at the end of that year. The antitrust watchdog concluded in December 2023 that Swisscom had abused its market dominance and fined it 18 million francs.

The Federal Administrative Court said Swisscom didn't hold a dominant market position on the relevant specific market and that its appeal was well founded for this reason.

The court said its judgment might be appealed to Switzerland's Federal Supreme Court.
