Takeda Books $2.5 Billion Provision Related to Amitiza Antitrust Litigation

Takeda Pharmaceutical revised its annual results to a net loss after booking a provision of $2.52 billion for antitrust litigation related to constipation drug Amitiza.

The Japanese drugmaker said Friday that it booked an additional provision for legal proceedings of 402.5 billion yen and recorded a net loss of Y152.39 billion for the fiscal year ended March.

The company previously reported net profit of Y191.76 billion.

Takeda said in May that a jury in the U.S. District Court for the District of Massachusetts returned a verdict against the company in the Amitiza antitrust litigation and that it was assessing the amount of the provision to be recognized for the year ended March.

The drugmaker said Friday that it didn't expect the antitrust litigation to materially affect its earnings forecasts for this fiscal year.

Takeda also said the amount of any liability to be imposed on the company hasn't been finalized. The company intends to pursue posttrial motions and an appeal and will seek a stay of execution of the judgment during the pendency of the appeal, it said.
