Bayer Files Lawsuit Against J&J, Alleging False Advertising for Prostate-Cancer Drug — Update
By Nicholas G. Miller
Bayer filed a lawsuit against Johnson & Johnson and its Janssen Biotech unit, alleging that marketing claims regarding the superiority of J&J's Erleada prostate-cancer drug versus Bayer's Nubeqa are based on flawed data.
J&J said earlier this month that a study found that Erleada caused a 51% reduction in risk of death for patients with metastatic castration-sensitive prostate cancer versus Nubeqa without the concurrent use of chemotherapy drug docetaxel.
Bayer said the claims are based on "scientifically flawed data and are not supported by a true head-to-head clinical trial."
The German company said J&J didn't adequately measure critical prognostic and baseline characteristics, such as non-cancer comorbidities, and that the patient population on Erleada in the analysis was five times the size of the group taking Nubeqa.
"Johnson & Johnson stands by the rigor and integrity of our real-world, head-to-head analysis," J&J said in a statement.
